The website is operated by SleepWell DME (“SleepWell,” “we,” “us,” or “our”).

By accessing or using the website, you acknowledge that you have read, understood and agree to these Terms. If you do not agree, do not use the website.

1. Website Purpose

SleepWell DME provides information and support relating to durable medical equipment, including CPAP, APAP and BiPAP machines, masks, tubing, filters, humidification equipment, replacement supplies, insurance processing and related patient-support services.

The website may allow users to:

  • Request information;

  • Contact SleepWell;

  • Download prescription or order forms;

  • Request replacement supplies;

  • Submit information relating to an equipment order;

  • Access patient, billing or payment services;

  • Review educational materials; and

  • Communicate with SleepWell regarding equipment and support.

Availability of particular products or services may depend on a valid prescription, medical documentation, insurance requirements, service area, product availability and applicable law.

2. Not Emergency or Medical-Diagnosis Services

The website is not an emergency service.

Call 911 or seek immediate medical attention if you are experiencing a medical emergency, severe breathing difficulty, chest pain, loss of consciousness or another urgent condition.

Website content is provided for general educational and informational purposes. It is not intended to:

  • Diagnose sleep apnea or another medical condition;

  • Replace a sleep study, physical examination or professional medical judgment;

  • Create a physician-patient relationship;

  • Recommend that you begin, stop or modify treatment; or

  • Replace instructions from your prescribing physician or equipment manufacturer.

3. Prescription Requirements

Certain CPAP, APAP and BiPAP devices, settings, accessories and services require a valid prescription or written order from an appropriately licensed health care provider.

Submission of information through the website does not guarantee that an order will be accepted or fulfilled.

SleepWell may require:

  • A valid, signed and dated prescription;

  • A qualifying diagnosis;

  • Sleep-study results;

  • Clinical documentation supporting medical necessity;

  • Physician notes;

SleepWell may contact the patient, prescriber, insurer or other authorized party to obtain missing or corrected documentation.

4. Insurance and Financial Responsibility

Participation with an insurer does not guarantee that:

  • A particular product or service is covered;

  • An order will be approved;

  • Prior authorization will be granted;

  • A deductible has been satisfied;

  • A patient will have no out-of-pocket obligation; or

Benefit verification and cost estimates are not guarantees of payment. Coverage decisions are made by the applicable insurer or health plan.

You remain responsible for charges not paid by your insurer, including deductibles, copayments, coinsurance, noncovered items, upgrades and amounts resulting from failure to meet payer requirements, except where prohibited by law or contract.

5. CPAP Compliance and Continued Coverage

Some insurers require patients to meet usage, documentation, follow-up or compliance requirements for continued coverage of PAP equipment.

It is the patient’s responsibility to:

  • Use equipment as prescribed;

  • Attend required follow-up appointments;

  • Communicate equipment or mask-fit issues promptly;

  • Follow insurer requirements;

  • Provide requested documentation; and

  • Notify SleepWell of changes in medical condition, prescription or coverage.

Failure to satisfy an insurer’s compliance requirements may result in denial of coverage or patient financial responsibility.

SleepWell does not control an insurer’s coverage, compliance or reimbursement determinations.

6. Equipment Use and Safety

You agree to use all equipment and supplies:

  • Only for the patient for whom they were prescribed;

  • In accordance with the prescription;

  • In accordance with manufacturer instructions;

  • In accordance with training provided by SleepWell or a health care provider; and

  • In compliance with applicable warnings and safety information.

Do not independently change prescribed pressure settings, discontinue prescribed therapy or use another person’s prescription device without authorization from a qualified health care professional.

You should promptly report damaged, malfunctioning or recalled equipment. Stop using equipment and contact SleepWell or the manufacturer when continued use may be unsafe.

SleepWell is not responsible for injury or damage caused by misuse, unauthorized modification, failure to follow instructions, use contrary to a prescription or use of incompatible accessories.

7. Replacement Supplies

Supply-reorder requests are subject to:

  • Eligibility;

  • Prescription validity;

  • Insurance replacement schedules;

  • Medical necessity;

  • Available inventory;

  • Verification of patient information; and

  • Applicable payment obligations.

Submitting a reorder form does not constitute confirmation or acceptance of an order. SleepWell may contact you before processing or shipping supplies.

Replacement schedules displayed or discussed by SleepWell are general guidelines. Actual eligibility is determined by the applicable insurer, prescription, clinical need and payer rules.

8. Returns, Exchanges and Warranties

Returns and exchanges may be restricted for medical, hygiene, safety, prescription, insurance or reimbursement reasons.

Opened, used, fitted, customized or patient-specific medical products may be nonreturnable except where defective or otherwise required by law.

Products may be covered by a manufacturer’s warranty. Warranty eligibility, coverage, exclusions and remedies are determined by the applicable manufacturer’s warranty terms.

Contact SleepWell before returning any product. An attempted return does not guarantee a refund, exchange or insurance adjustment.

Any specific return, exchange, warranty or mask-fit policy provided to you in writing as part of your order will supplement these Terms. In the event of a conflict, the more specific written policy will govern that transaction.

9. Accuracy of Information You Provide

You agree to provide complete, current and accurate information.

You may not:

  • Impersonate another person;

  • Submit information without authorization;

  • Falsify a prescription or medical record;

  • Misrepresent insurance coverage;

  • Submit fraudulent claims or requests;

  • Interfere with an order for another patient; or

  • Use the website for unlawful activity.

You are responsible for promptly correcting inaccurate information.

Health care providers submitting information represent that they are authorized to do so and that submitted orders and documentation are accurate to the best of their knowledge.

10. Privacy and Protected Health Information

Our collection and use of information through the website is described in our Website Privacy Policy.

Protected health information maintained by SleepWell is also governed by our Notice of Privacy Practices and applicable health-information laws.

Do not use a general website contact form to communicate an emergency or to transmit highly sensitive information unless the form specifically requests that information and is approved for that purpose.

You are responsible for maintaining current contact information.

Consent to receive promotional marketing communications is not a condition of receiving medically necessary equipment or services.

To the extent permitted by law, you agree to defend, indemnify and hold harmless SleepWell and its owners, officers, employees, contractors and agents from claims, liabilities, damages and expenses arising from:

  • Your unlawful use of the website;

  • Your material violation of these Terms;

  • Fraudulent information submitted by you;

  • Your infringement of another person’s rights; or

  • Your intentional misuse of equipment or website services.

This provision does not require a patient to indemnify SleepWell for SleepWell’s own negligence, violation of law or breach of its legal duties.

19. Governing Law and Venue

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles.

Unless applicable law requires otherwise, a legal action arising solely from use of the website must be brought in a state or federal court with jurisdiction over Macomb County, Michigan.

Before filing a lawsuit relating solely to website use, the parties are encouraged to attempt to resolve the dispute through good-faith written communication.

This section does not prevent a person from submitting a complaint to a government agency or exercising rights that cannot legally be restricted.

20. Changes to These Terms

We may update these Terms from time to time.

Revised Terms will be posted on this page with an updated “Last Updated” date. Changes apply prospectively unless otherwise required by law.
